Legislative Note

The rationale for the promulgation of this Act is as follows: Since the lease of immovable property under the Civil and Commercial Code possesses the nature of a personal contractual right (jus in personam) binding specifically between the contracting parties, it entails certain limitations regarding its economic utilization. Furthermore, the lease of immovable property under the law on the lease of immovable property for commercial and industrial purposes has a highly restricted scope of application, rendering it unavailable for use in many circumstances.

It is therefore deemed appropriate to establish “Sap-Ing-Sith” as a real property asset anchored on the right of utilization over an immovable property, which can be freely transferred and designated as security for obligation performance via mortgage. This will directly promote and support real estate investments and drive the country’s overall economic growth. It is therefore necessary to enact this Act.
